A case let say john was fall onto the floor when walking. Sam saw it and ran to find a doctor called "joe'. But joe refused to help. John then suffered brain damage when fall onto the floor. Finally, if joe able to help and followed sam to help john. John might able to rescue and no brain damage. Mag Court said even it was forseeable but infsufficient proximity not fair for joe to own duty of care to john. Now if john appeal at a higher court and what will be the outcome and anlaysis of this case if you are the jury or judgeman about this only duty of care issue.
I hope some "United Kingdom" relevant case can be cited if possible.
Any citation case ie. baro v moore that is similiar with evaluation by the lord justice.
