好像不確。剛看過一本書: 1948年東京遠東軍事法庭判決甲級戰犯共28人，7人判絞刑, 計有東條、松井石根、板桓征四郎、土肥原賢二...等，餘21人判徒刑。据書中28人名單，磯谷名字並未列甲級，自然也沒有被 "度頸" 了。

又: 最可恨是頭號大戰犯裕仁可以逃出生天, 並安享瑕齡。蓋當時的軍事法庭由美國佔領軍主導，美方有意培植日本以對抗掘起中的蘇聯，因而做得就住就住。此外，生化戰先驅731部隊的頭目亦被美軍網羅而免被起訴。

wiki 有如下記述﹕

1946年，国民政府在南京军事法庭判以战争罪行审判矶谷廉介。矶谷廉介被判无期徒刑，后来提早获释，1967年于日本逝世。
