one simple question, did u or did u not take those photos by yourself??  You only need to reply, "Yes" or "No"... it's a fairly simple question.

if those photos were taken by you and the people(s) featured in the photos were informed and permitted you to take those photographs, then u do own the publishing rights of those photos.

otherwise, u've already infringed the intellectural rights of the original photographer.

i'm not a legal expert but i believe this should be a civil issue, not a criminal issue, so it is up to the original photographer to decide whether he/she wants to take proper legal action against that/those person(s).  

thus, if no one raises objection against the posted photos, we would not discourage members from posting, cos they might have got usage approval from the original photographer prior to their postings, then it will be alright.

the above is jus my 2 cents, yet i do respect other's intellectural rights as much as possible.
