Jockey E Saint-Martin suspended for one month

The Stewards today inquired into the reason for Jockey E Saint-Martin failing to remain at an inquiry conducted at the Sha Tin racemeeting on 1 May 2009. As Jockey Saint-Martin left the inquiry without permission prior to it being officially concluded, the Stewards decided on 1 May 2009 that he be stood down from riding in races with immediate effect until he appeared at an inquiry to determine his conduct.
Evidence including a written submission was today taken from Jockey Saint-Martin. Jockey Saint-Martin pleaded guilty to a breach of Rule of Racing 155(27) which states: " No person shall refuse or fail to attend or remain at any inquiry, appeal, investigation or protest/objection hearing when required to do so in terms of these Rules." The particulars of the charge were that Jockey Saint-Martin did fail to remain at a Racing Stewards' inquiry held in the Sha Tin Racecourse Inquiry Room at about 7:00 pm on Friday 1 May 2009 when required to do so.
In determining an appropriate penalty, the Stewards were mindful that Jockey Saint-Martin pleaded guilty to the charge and showed contrition before the Stewards today. On the other hand, the Stewards were also mindful of Jockey Saint-Martin's poor disciplinary record in relation to conduct related matters. In the circumstances, it was decided appropriate that Jockey Saint-Martin be suspended from riding in races for a period of one month. The commencement of this suspension was backdated to 1 May 2009 on which day Jockey Saint-Martin had been stood down from riding in races. Jockey Saint-Martin is eligible to resume riding in races on 1 June 2009.
As Jockey Saint-Martin is suspended from riding in races, he is not eligible to fulfil his declared riding engagements at the Happy Valley racemeeting on Wednesday 6 May 2009. As such, the Stewards have permitted the following substitutions which were initially declared as standby riders:-
Race 3 FLY HIGH H W Lai
Race 5 MAN IN THE MIRROR O Doleuze
Race 7 INVINCIBLEKINDNESS O Doleuze
(promoted standby runner)
When Jockey Saint-Martin appeared before the Stewards today, he was told his standard of dress when he returned to the Sha Tin Racecourse on 1 May 2009 for an inquiry into interference in Race 8 was not appropriate. He was also told the Stewards did not accept the evidence tendered by him during that inquiry. Further, he was notified the initial evidence provided by him at the inquiry into the reason for him having left
