In fact, you don't need that bloody Trade Union at all.  

But one of the criteria you need to meet is working in that organization continuously for at least two years before they made you redundant, otherwise Labour Tribunal would not accept your case.

In my case, in every disciplinary interview, the concerned staff was allowed to bring along a member of the Trade Union as his witness. He hadn't done so but you coudn't imagin how tediou it was while preparing piles of documents justifying the dismissal. Worst of all, it spoiled my X'mas holidays.

Sure mate, under the UK Employment/Labour Law, you¡¦d allow your staff to be accompanied by a member of the relevant Trade Union, or his/her co-worker if no Trade Union is involved, in a Disciplinary Interview if he/she so desired.

However, if your staff has not got anybody accompanied him/her in the interview, to play safe, I¡¦d suggest that you¡¦d ask one of your staff, preferably of supervisory/managerial grade, to go with you in such an interview taking minutes or as a witness.

No, no one would like to conduct such kind of interview before the X¡¦mas unless he¡¦d like to ruin his lovely holidays ahead. I¡¦d imagine how bad your situation was, it couldn¡¦t be a happy meeting at all, and that¡¦s why I really don¡¦t want to be a manager or even a supervisor if I¡¦d have a choice.

I¡¦d like to work on my own with no staff under my supervision if at all possible, but there is no such kind of job in reality, what a pity!

Smart you, My Lord.

I was accompanied by the Director of Sales and HR Manager throughout the process. The staff's service with the company was terminated in mid December but he indicated that he would appeal to the Labour Tribunal right after X'mas. In preparation for this, I would need to guide the team in London to prepare those tedious paper works while I was spending my X'mas holidays with Madam & Junior Tarocake in Harbin. Actually, what really bothered me was not the justification but the legitimacy of my decision. I held a management position but was not an employee of the company ( quite complicated to expalin ). He would definitely challenge the company if this was brought to his knowledge during then. Anyway, it's over !
Unlike you My Lord, I always find it challenging to undertake disciplinary actions and am particularly interested in managing problem staff.
